Terms of Service

1. Who We Are

BedWatch Africa Ltd ("BedWatch Africa", "we", "us", "our") is a healthcare technology company registered in Ghana. We operate the BedWatch Africa platform, mobile web application, and related services ("the Platform").

By creating an account or using the Platform, you agree to these Terms of Service. If you do not agree, do not use the Platform.

2. What BedWatch Africa Does

BedWatch Africa is a real-time hospital bed availability and emergency routing platform. We help subscribers identify which hospitals have available beds before they travel, and we route emergency cases to the nearest appropriate partner facility.

3. Your Account

• You must provide a valid Ghanaian phone number to create an account.
• Your phone number is your identity on the Platform — keep it secure.
• You are responsible for all activity under your account.
• You must be at least 18 years old to subscribe. Parents or guardians may subscribe on behalf of minors under a Family plan.
• One person per individual account. Family plans cover up to 5 named members.

4. Subscriptions and Payments

Subscriptions are processed by Paystack. By subscribing, you authorise us to charge your selected payment method for the plan amount on the billing date.

• Individual Annual: GHS 60/year
• Family Annual: GHS 200/year (up to 5 members)
• Individual Monthly: GHS 5/month
• Family Monthly: GHS 16.67/month
• Day Pass: GHS 15 for 24 hours of access

Subscriptions renew automatically unless cancelled before the renewal date. Day Passes do not renew. Prices are in Ghana Cedis (GHS) and are subject to change with 30 days’ notice.

5. Cancellations and Refunds

You may cancel your subscription at any time from your account dashboard. Cancellation takes effect at the end of the current billing period — you retain access until then.

We do not offer refunds for partial periods except where required by Ghanaian consumer protection law. Day Pass fees are non-refundable once the 24-hour access period has begun. Contact info@bedwatchafrica.com for billing disputes.

6. BERF — Emergency Response Fund

Annual subscribers have access to the BedWatch Emergency Response Fund (BERF), subject to the separate BERF Terms and Conditions. BERF is a subscriber solidarity fund, not an insurance product.

7. Acceptable Use

You must not:

• Trigger false emergency alerts
• Attempt to defraud the BERF fund
• Share your account with anyone outside your named plan members
• Use the Platform for any commercial purpose without our written consent
• Attempt to reverse-engineer, scrape, or copy any part of the Platform
• Interfere with the Platform’s security or operation

Violations may result in immediate account suspension without refund.

8. Hospital Data Accuracy

Bed availability and hospital status data is provided in real time by partner facilities. BedWatch Africa displays this data in good faith but does not guarantee its accuracy. Always confirm bed availability directly with the hospital before travelling if the situation permits. BedWatch Africa is not liable for decisions made based on Platform data.

9. Limitation of Liability

To the maximum extent permitted by Ghanaian law, BedWatch Africa shall not be liable for:

• Loss or harm arising from reliance on bed availability data
• Delays in emergency routing or transport
• Actions or omissions of partner hospitals or ambulance services
• Platform downtime, errors, or interruptions

Our total liability to you for any claim shall not exceed the amount you paid us in the 12 months preceding the claim.

10. Changes to These Terms

We may update these Terms from time to time. We will notify you of material changes by SMS or in-app notification at least 14 days before they take effect. Continued use of the Platform after the effective date constitutes acceptance of the updated Terms.

11. Governing Law

These Terms are governed by the laws of the Republic of Ghana. Any disputes shall be subject to the exclusive jurisdiction of the courts of Ghana.
